Terms and conditions

These TOP Card Terms and Conditions regulate the conditions of use between the cardholder and The Orange Company, Inc., effective upon the purchase of a TOP Card.

1. The Cardholder can reload and use your TOP Card at all Hop-on Hop-off Shuttle Services of Southwest Tours and other TOP Merchants that display the TOP Logo.

2. The cost of the TOP Card is 100 PHP with an inclusion of 50 PHP TOP load.

3. The TOP Card may be rejected if (1) it has expired or your TOP Card has been reported lost or stolen; (2) The remaining balance of your TOP Card - which can be seen at the TOP.PH application is insufficient; (3) It has been damaged or is malfunctioning.

4. TOP.PH shall not be held liable for the state, quality, or appearance of the goods or services purchased using the TOP Card. TOP Card is only a medium of payment. All concerns related to the aforementioned must be addressed to the TOP merchant.

5. Per transaction, the Cardholder may reload the TOP Card with a minimum of twenty pesos (₱20.00) and a maximum of ten thousand pesos (₱10,000.00).

6. The Cardholder may reload the TOP Card at the TOP.PH app, the Orange Pods, or any authorized TOP reloader that displays the TOP Logo.

7. The Cardholder must properly take care of their TOP Card to avoid damages such as scratches, tears, cuts, bends, or breaks, and shall not damage and destroy the card purposefully.

8. TOP Card remains to be the property of TOP. The Cardholder should not copy, duplicate, modify, and/or alter TOP Card, including its software and program.

9. The Cardholder must be responsible for protecting their TOP Card against theft, damage, or loss. If the card is lost, the balance will not be refunded unless it is linked to the user’s TOP.PH account.

10. If the TOP Card is not functioning due to improper use, the Cardholder may purchase a new TOP card as a replacement.

11. The TOP Card may only be loaded via TOP.PH app, Orange Pods, or any partner TOP Card Merchants. The TOP Card load may not be transferred from one card to another unless the card is linked to the user's TOP.PH account.

12. TOP Card load is NOT exchangeable to cash nor transferable to TOP.PH Wallet and other TOP Cards. unless the card is linked to the user's TOP.PH account.

13. For the linked TOP Cards to the TOP.PH app, replacing your lost or stolen linked TOP Cards shall require a valid proof of identity.

14. For lost or stolen cards, you may deactivate them through your TOP.PH account or contact TOP.PH hotlines at +63 917 672 6438 / +63 917 672 6430.

15. If found lost TOP Card, please return it to our office at The Orange Company Office, Station 2, Bo. Manggayad, Boracay Island, Malay, Aklan.

16. Any misrepresentation, fraud, fault, or misconduct by a third party, including but not limited to owners, employees, authorized representatives, agents of TOP Merchants, TOP Card reloaders, and distributors, shall not be subject to TOP.PH liability.

17. For reasons not due to our fault or negligence, TOP.PH shall not be held responsible for non-performance, error, interruption, or delay in the execution of our responsibilities due to the following:

1. Natural calamities such as floods, lightning, fires, earthquakes, and others;
2. Terrorist activity, a revolution, treason, a coup d'etat, or analogous actions;
3. Power outage;
4. Situations in which third-party telecommunications carriers prevent the use of communications lines, computers, or the TOP Card Merchants, TOP Card reloaders, and distributors; and
5. Actions or inactions of individuals, organizations, or places for which we are not liable.
